This Privacy Policy explains how personal data is processed in connection with the FractAudio website, Ambience Cutter trial requests, licence activation and validation, support communications, and related product services.

The data controller is:

2. What This Policy Covers

This Policy applies to:

  • visits to fractaudio.com;
  • Ambience Cutter trial requests;
  • licence activation, deactivation, and validation;
  • support requests and product-related communications;
  • purchases and order-related communications connected with FractAudio products.

3. Personal Data We Process

Depending on how you use the website or product, FractAudio may process the following categories of data:

a. Licensing and activation data

  • machine_hash: a one-way SHA-256 hash derived from the device identifier used by the licensing system;
  • machine_label: the device name or hostname, if transmitted by the plug-in;
  • platform: for example macos or windows;
  • app_version: for example 2.1.0;
  • licence status, activation date, deactivation records, validation timestamps, and related licensing events.

Although the machine hash is pseudonymous and does not directly reveal the original hardware identifier, FractAudio treats it as personal data when it can be associated with a licence, an email address, an order, or a specific user or device.

b. Trial and account-related data

  • email address, where provided for a trial request, support request, or purchase-related communication;
  • information necessary to deliver or manage a trial or licence;
  • correspondence sent to FractAudio support.

c. Website and technical data

  • IP address and standard server log information;
  • browser, device, and request metadata reasonably necessary for security, fraud prevention, and service operation;
  • technical cookies or similar technical storage strictly necessary for core website functionality, where used.

d. Purchase and transaction-related data

For purchases processed through Lemon Squeezy checkout, FractAudio may receive order-related information such as:

  • customer name;
  • customer email address;
  • order reference or transaction reference;
  • product purchased;
  • licence fulfilment status;
  • refund or chargeback status where relevant.

FractAudio does not process full payment card details. Payment processing is handled through the Merchant of Record checkout flow.

4. What We Do Not Intentionally Collect Through the Plug-in

FractAudio does not intentionally collect through the Ambience Cutter plug-in:

  • audio content;
  • session audio data;
  • session names, region names, or project names;
  • project IDs;
  • usage analytics, click tracking, or behavioural telemetry, except for limited licensing and security events strictly necessary to operate the licensing system.

5. Why We Process Personal Data

FractAudio processes personal data for the following purposes:

  • to deliver trials, licence keys, downloads, and updates;
  • to activate, validate, manage, and protect software licences;
  • to prevent abuse, repeated trial circumvention, fraud, unauthorized redistribution, and security incidents;
  • to provide customer support and respond to product-related requests;
  • to send essential service communications related to a trial, licence, activation issue, or support matter;
  • to maintain website and service security, logs, and technical integrity;
  • to comply with legal obligations and handle disputes, chargebacks, or enforcement issues.

FractAudio does not use your data for unrelated third-party marketing and does not sell personal data.

6. Legal Bases

Depending on the context, FractAudio processes personal data on one or more of the following legal bases:

  • performance of a contract or pre-contractual steps, for trial delivery, licence activation, product access, and support related to a purchase or trial;
  • legitimate interests, including protection of the licensing system, fraud prevention, service security, abuse prevention, and basic service administration;
  • compliance with legal obligations, where records must be retained or disclosed by law;
  • consent, where consent is specifically requested for an optional communication or optional data submission.

7. Who Receives the Data

FractAudio may share relevant personal data only where necessary with:

  • hosting or infrastructure providers;
  • licensing or activation service providers, if any;
  • email delivery or customer support providers, if any;
  • Lemon Squeezy, for transactions processed through its Merchant of Record checkout;
  • professional advisers or authorities where legally required or reasonably necessary to protect legal rights.

FractAudio does not share personal data with advertising networks for profiling or marketing purposes.

8. International Transfers

Some service providers used in connection with website hosting, infrastructure, checkout, email, or support may process data outside your country or outside the European Economic Area.

Where applicable, FractAudio will rely on appropriate legal safeguards for such transfers as required by data protection law.

9. Data Retention

FractAudio keeps personal data only for as long as reasonably necessary for the purposes described in this Policy, including:

  • licence and activation records: for as long as needed to manage the licence, enforce licence limits, and maintain security and support continuity;
  • support correspondence: for as long as needed to handle the request and maintain a reasonable support history;
  • transaction-related records: for the period required by tax, accounting, legal, or dispute-handling obligations;
  • technical logs: for a limited period reasonably necessary for security, diagnostics, and abuse prevention.

Where retention is no longer necessary, data will be deleted or anonymized where reasonably practicable, unless continued retention is required by law or necessary to establish, exercise, or defend legal claims.

10. Your Rights

Subject to applicable law, you may have the right to:

  • request access to your personal data;
  • request rectification of inaccurate data;
  • request deletion of data;
  • request restriction of processing;

FractAudio may request reasonable information to verify the identity of the person making the request before acting on it.

11. Security

FractAudio uses reasonable technical and organizational measures to protect personal data against unauthorized access, loss, misuse, or unlawful disclosure. However, no internet-based system can be guaranteed to be completely secure.

12. Children

FractAudio products and services are not directed to children. FractAudio does not knowingly collect personal data from children.

13. Product-Specific Licensing Notes

For transparency, Ambience Cutter currently uses a machine-based licensing system that may process a pseudonymous machine hash, machine label, platform, application version, and related activation or validation events in order to operate one-machine licence limits, trial enforcement, licence revalidation, deactivation, and abuse prevention.

If you replace the logic board, migrate to another machine, or lose access to an old machine, you may contact support@fractaudio.com for licence assistance.

These product-specific licensing notes are provided for convenience and do not replace the full Terms and Conditions or product documentation.

14. Cookies and Similar Technologies

If the FractAudio website uses only technical cookies or similar tools strictly necessary for core site functionality, no consent banner may be required under applicable rules, but relevant information will still be provided.

If analytics, embedded third-party media, marketing tools, or non-technical trackers are introduced, FractAudio may update this Policy and any related cookie notice or consent mechanism accordingly.

15. Changes to This Policy

FractAudio may update this Privacy Policy from time to time to reflect changes to the website, product infrastructure, legal requirements, or licensing systems. The updated version will be posted on the website with a revised “Last updated” date.
